Moore Payne Law Files Lawsuit Against The Addison of Oviedo After Tragic Death at Assisted Living Facility

Orlando, FloridaMoore Payne Law, an Orlando-based law firm specializing in nursing home negligence, medical malpractice, and catastrophic personal injury cases, has filed a negligence case in partnership with Turnbull Injury Law. The firms represent the family of Periakaruppa Chockalingam, who died after what the family believes was a preventable incident at The Addison of Oviedo, an assisted living facility in Oviedo, Fla. with a documented history of substandard care.

The lawsuit alleges Dr. Chockalingham, an 81-year-old resident at the facility, was found unresponsive on the morning of December 15, 2024 after repeatedly activating the facility’s emergency alert system with no response. The suit further claims that Addison of Oviedo staff failed to supervise and respond to Dr. Chockalingam’s repeated calls for help, resulting in his death. The lawsuit asserts that rather than responding to Dr. Chockalingam’s calls for help, the assigned employee was sleeping in his car in the parking lot and  police would go on to find marijuana in the employee’s car.

“Our client is devastated by the loss of their loved one and is rightfully seeking accountability for a death that never should have happened,” said Geoff Moore, Esq., founding partner of Moore Payne Law. “What’s especially troubling is that this facility has a documented history of violating the state’s minimum safety requirements without making any meaningful changes. The evidence will show that what happened to our client wasn’t a one-time mistake. What happened to Dr. Chockalingam was the result of a pattern of corporate conduct putting profits of people.”

Prior state investigations reveal a pattern of safety lapses and regulatory violations at the facility, including failures in supervision, background screening for new hires, staff training, and emergency preparedness. Over the past two years, inspections documented unreported changes in residents’ conditions, unwitnessed falls, and resident abuse.

Prior to his retirement, Dr. Chockalingam was a local cardiologist who spent a majority of his life helping others in his community. He was the founder of the Nagarathar Sangam of North America (NSNA), a nonprofit, community-based organization established to preserve and protect the heritage and culture of the Nattukottai Nagarathar community.

“It’s hard to put into words what it feels like to know my dad was calling for help and no one came,” said Kannan Chockalingham, the victim’s son. “He spent his whole life caring for others, as a doctor, a father, and a friend. We’re speaking out because this should never have happened to him, and we want to do everything we can to make sure no other family has to go through this kind of loss, wondering if their loved one’s death could have been prevented.”
