Ealing Council coerced Errol Baptiste the Claimant into silence by preventing him speaking about ongoing dispute regarding severe housing disrepair, including damp, health hazards, leaks, mould, moisture, and rat infestations. Ealing Council instead brought a criminal harassment case against Mr. Baptiste, by alleging he was a ”serial harasser” in their court filings by covering up their corporate failing to repair and maintain its properties breached its policy for managing disrepair claims by forcing Errol Baptiste the Claimant into an attempt silence agreement this incluses coercion without going through the Claimant’s lawyers and restricting free speech about the housing disrepair as unlawful act of coercion with harassment under the Protection from Harassment Act 1997 breaches Freedom of Expression and Freedom of Assembly under Article 10, and Article 11 of the European Convention on Human Rights.

Ealing Council breached their legal duty under the Landlord and Tenant Act 1985 to ensure properties are safe, streucturally sound, and have working essential services such as heating, water, and electricity.
A tenant has the right to legal representation throughout the housing disrepair process as freedom of assembly under Article 11 of the European Convention on Human Rights. Ealing Council were in breach of Article 11 failed to communicate with the Claimant’s lawyers on notification of representation. Ealing Council abused its powers for improper motives by making untruthful defamation claims of harassment as in their failed bid to imprison Errol Baptiste on extreme false charges of harassment to cover up their corporate failure regarding the housing disrepair as racism and retaliation on their false pretext under the Protection from Harassment Act 1997. The outcome of the court case at Uxbridge Magistrates’ Court on October 22, 2024, which Errol Baptiste was acquitted of harassment charges brought by Ealing Council.

Ealing Council acted with retaliation with victimization towards Errol Baptiste following his acquittal that he was mentioning the corporate failure on the housing disrepair, and the Council attempted to prevented Errol Baptiste the tenant from discussing legitimate housing disrepair issues is in breach on freedom of expression under Article 10 of the European Convention on Human Rights as in the context of a public interest.
Ealing Council as the corporate attempted by restricting Errol Baptiste the claimant to pursue a claim and making his living situation extreme difficult since November 2021 in response to a disrepair complaint as harassment and victimisation without going through his lawyers committed criminal offences by breaching and infringing his subject access data rights under the Data Protection Act 2018, Section 45, Section 94, and GDPR 2018, Article 15 breach their policy on information management and knowledge by not updating their information system.
